Re: Notice of unsafe road conditions existing at Cornerview Road, Gonzales

Sir:

Senate Bill 858 was passed into law by governor Foster in the 1999 regular session. My interpretation of the act, in laymen’s terms is, that just because a road does not comply with standards set by federal guidelines does not mean it's unreasonably dangerous. It must be proven that the failure to meet the standard requirements was the proximate cause of an accident because of it resulting in an unreasonably dangerous condition.

It is also my understanding that because of this law, that the sate and/or parish, must be put on notice before they can be held liable for property damage, injury, or death due to discrepancies that exist for that particular road in a court of law.

With receipt of this letter, consider the Parish of Ascension put on notice as to the unsafe conditions existing on Cornerview Road in Gonzales using descriptions below.

I point out the lack of sufficient warning signs for the set of right angle, and almost right angle curves, from the intersections of Chester Diez Road to Boudreaux Road.

It has also been my experience in the past seven years to see numerous speeders on this road day after day, going at a high enough rate of speed to have their vehicles be on the wrong side of the road in the curves mentioned. While this is not under your jurisdiction, I point it out anyway, as a courtesy copy of this letter is also sent to the Ascension Parish Sheriff.

While I point out only certain areas of the road for particular safety issues, be advised that there are numerous safety hazards the entire length of Cornerview Road. E.g., lack of painted lines, warning signs, reflectors, guardrails, and shoulders to name a few. The complete extent of the hazards for Cornerview Road need to be investigated by the Ascension Parish Department of Public Works to insure that all safety hazards be found and remedied with all possible haste.

Be advised, if there is any property damage, injury, or death after the date of this notice on Cornerview Road, I will do my utmost to bring this notice to the attention of those involved and their attorneys.

To the Ascension Parish President et al
 
Sir,
On July 23rd I submitted a formal notice as to what I believe to be serious safety hazards with regards to Cornerview Road. As of this date I see absolutely no effort on the parish's part to remedy this situation.
 
Might I remind you of Boudreaux Road? I submitted a formal notice of safety hazards, and two follow up requests for that road, and nothing was done until after a nineteen year old boy lost his life there.
 
Whether or not an effort by the parish would have prevented this needless death is anybody's guess. But, as they say, "an ounce of prevention".
 
I would appreciate your immediate attention and remedies to the safety issues that now exist on Cornerview RoadCornerview Road.

With receipt of this letter, consider the State of Louisiana Department of Transportation put on notice as to the unsafe conditions that exist at the intersection of Burnside and Cornerview Road in Gonzales.

The existing conditions involve the left turn signal for motorists turning left on to Cornerview Road. This signal stays green for approximately two seconds. Because of this ridiculously short interval motorists are turning left on to Cornerview Road against on coming traffic and a red light.

Be advised, if there is any property damage, injury, or death after the date of this notice that I will due my utmost to bring this notice to the attention of those involved and their attorneys.

Mr. Carter,
Thank you for your quick response.

I believe your explanation of the of the ridiculously quick change time of the left turn signal completely missed the point. This time duration may meet federal or state standards, but it is still not a sufficient amount of time for motorists to make their turn safely.

I request that you or someone in the D.O.T.D. investigate the matter further instead of dismissing my notice with an explanation of a turn time that amounts to a measly five or ten seconds.

Subject: Turn signal at Cornerview & Burnside

Mr. Carter,
Forgive the very late response with regards to the subject of the turn signals at Cornerview and Burnside.

Your explanation of not wanting to make turn signals more than, and I believe your response was 7 seconds, is ludicrous.

The turn signal at Worthy is at least 30 seconds in duration. Also 7 seconds does in fact include the yellow warning which I thought meant to be prepared for a red signal. Not keep on going and hazard the possibility of running a red light and possibly be ticketed or hit by on coming traffic.

Also in your response you suggested that I "lighten up". I'll lighten up when you and your organization tighten up! This parish has a totally unacceptable traffic death rate. Your road system and the total lack of traffic law enforcement are the prime factors for this death rate. Again you tighten up and I'll lighten up.
