Senate Bill 858 was passed into law by Governor Foster in the 1999 regular session. My interpretation of the act, in laymen’s terms is that just because a road does not comply with standards set by federal guidelines does not mean it's unreasonably dangerous. It must be proven that the failure to meet the standard requirements was the proximate cause of an accident because of it resulting in an unreasonably dangerous condition.
It is also my understanding that because of this law, that the sate and/or parish, must be put on notice before they can be held liable for property damage, injury, or death due to discrepancies that exist for that particular road in a court of law.
With receipt of this letter, consider the Parish of Ascension and/or the State of Louisiana put on notice as to the unsafe conditions existing on L Landry Road in Gonzales using the descriptions below.
While I point out only certain areas of L Landry Road the same conditions are found its entire length.
I might also point out that with the opening of the new school on Highway 621 this road has become a main thoroughfare for parents, students, and school buses.
Be advised, if there is any property damage, injury, or death after the date of this notice on L Landry Road because of the safety issues described in this letter that I will do my utmost to bring this notice to the attention of those involved and their attorneys.

Hi Chuck,Thanks again for your comments. But the Councilman in this area had put this on the list to widen. Then the folks would not sale the right a way. So, he backed off and now still nothing being done. I wish he would at least do an overlay and stripping. This would at least help the condition of the road. Maybe the New Council will take more action. I live on this road and I know what you are talking about.Thansk,Harold

Mr. Marchand,
I have just viewed the road repairs made to LLandry Road. And I must tell you that they are totally unacceptable.
Cold patch dumped haphazardly into pot holes and broken asphalts on the roads shoulders is not my idea of repairing a road to make it safe for parish motorists. The safety hazards I previously reported still exist.
Please take the time to view the unprofessional repairs made by the public works department and have changes made.
